CONCERNING
GIVING FOOD ALLOWANCE FOR CIVIL GOVERNMENT EMPLOYEE

THE MINISTRY OF FINANCE,

Considering:

• a. to create a legal framework to increase Civil Government Employee wealth, beside salary and other allowance, he/she also receive food allowance;
• b. that rate of Civil Government Employee is arranged in Regulation of the Minister of Finance No. 96/PMK.02/2006 concerning standard of Cost for Fiscal Year 2007;
• c. that based on consideration as described in paragraph a and b above, it is necessary to stipulate Regulation of the Minister of Finance concerning Giving Food Allowance for Civil Government Employee;

In view of:

• 1. Law No. 8/1974 concerning Principles of Employee Affair (Statute Book Republic of Indonesia Year 1974 No. 55, Supplement to Statute Book No. 3041) as has already been amended with Law No. 43/1999 (Statute Book Republic of Indonesia Year 1999 No. 169, Supplement to Statute Book No. 3890);
• 2. Law No. 17/2003 concerning State Financial (Statute Book Republic of Indonesia Year 2003 No. 47, Supplement to Statute Book No. 4286);
• 3. Law No. 1/2004 concerning State Treasury (Statute Book Republic of Indonesia Year 2004 No. 5, Supplement to Statute Book No. 4355);
• 4. Law No. 15/2004 concerning Inspection of Management and Responsibility for State Financial (Statute Book Republic of Indonesia Year 2004 No. 66, Supplement to Statute Book No. 4400);
• 5. Presidential Decision No. 42/2002 concerning Guideline for Implementation of State Revenue and Expenditure Budget (Statute Book Republic of Indonesia Year 2002 No. 73, Supplement to Statute Book No. 4212) as has already been amended with Presidential Decision No. 72/2004 (Statute Book Republic of Indonesia Year 2004 No. 92, Supplement to Statute Book No. 4418);
• 6. Presidential Decree No. 20/P/2005;
• 7. Regulation of the Minister of Finance No. 96/PMK.02/2006 concerning standard of cost for Fiscal Year 2007;

HAS DECIDED:

REGULATION OF THE MINISTER OF FINANCE CONCERNING GIVING FOOD ALLOWANCE FOR CIVIL GOVERNMENT EMPLOYEE

CHAPTER I
GENERAL PROVISION

Article 1

In this Regulation of the Minister of Finance, the meaning of:

• 1. Civil Government Employee referred to Civil Government Employee as described in Law No. 8/1974 concerning Principles of Employee Affair as has already been amended with Law No. 43/1999, in State Ministries/Agencies environment.
• 2. Food allowance referred to allowance is given to Civil Government Employee based on tariff rate and calculated daily for food of Civil Government Employee.

CHAPTER II
TO GIVE FOOD ALLOWANCE

Article 2

(1) Civil Government Employee which works in decided working day get food allowance.

(2) Food allowance is given maximum 22 (twenty two) working days in one month.

(3) If more than 22 working days in one month, Civil Government Employee only gets food allowance for 22 (twenty two) working days.

(4) If in one month the working days are less than 22 working days, Civil Government Employee only gets food allowance for working days in that month.

Article 3

(1) Food allowance for Civil Government Employee is Rp. 10,000.00 (ten thousand rupiah) per working day.

(2) Food allowance is paid once in a month in the next month.

Article 4

Food allowance is not given to Civil Government Employee which absent in working day.

CHAPTER III
PROCEDURE TO PAY FOOD ALLOWANCE

Article 5

Payment of Food Allowance based on present list of Civil Government Employee.

Article 6

User/Attorney of Budged proposes Decision Letter to pay Directly (SPM-LS) to pay Food Allowance of Civil Government Employee to State Treasury Service Office (KPPN) with attachment:

• a. List of calculation for food allowance of related unit work; and
• b. Statement for responsibility of User/Attorney of Budget.

CHAPTER IV
OTHER PROVISION

Article 7

Procedure to request and pay the money for food alowance of Civil Government Employee is stipulated by Director General of Treasury.

CHAPTER V
CLOSING PROVISION

Article 8

This regulation of the Minister of finance shall come into effect at the date of stipulation and valid from 1 January 2007.

In order for everyone to be informed the regulation shall be published in State Gazette of the Republic of Indonesia.
